The purpose of the general conditions of sale is to define the conditions of sale of products and/or services through the website.

Acceptance of the general conditions of sale

With the stipulation of the PURCHASE CONTRACTS, according to the procedure, the user accepts and is obliged to observe these GENERAL CONDITIONS. It is therefore obliged to read carefully, before making any purchase transaction, these general conditions of sale which are accessible at all times from the website and shall prevail over any other document with which they contradict, without prejudice to the provisions of the legislation in force.

These sales are distance sales regulated by the Spanish legislation in force on the matter.

The validation of the order by the customer implies unreserved acceptance of these general conditions of sale. In the event that these general conditions of sale are modified, they will be binding for all purchases made after their publication on the Web site.

The user

The access, navigation and use of the Web Site, confers the condition of user. The User assumes responsibility for the correct use of the Website.

This responsibility shall extend to:

-Use this Web Site only to make inquiries and legally valid purchases or acquisitions.

-Do not make any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities will be informed.

Provide truthful and lawful contact data, e.g. e-mail address, postal address and/or other data (see Legal Notice and General Conditions of Use).

Purchase procedure

The contracting procedure may only be carried out in the Spanish language.

To purchase the products, the user will have to register on the website by entering his personal data and following the instructions of the registration wizard. He/she will have to fill in and send the order form in electronic format available on the website, following the instructions provided. All purchase order data must be filled in and checked.

In case the user is a professional, he/she may request the registration to ARUAL by filling in the form and sending it. The registration will be carried out manually by ARUAL. Subsequently, the user with professional status will be informed with the access data.

If the User does not wish to register, he/she may in any case terminate the purchase procedure, but he/she will not be able to check the status of his/her orders or take advantage of discounts and promotions.

Once registered, the user will be able to confirm the items that he/she has previously or subsequently entered in the corresponding “basket”.

In the next step you will have to choose the method of payment, which you can choose to be registered so that in the following occasions you do not have to select the payment, just confirm it. You will have to confirm that you have read and accepted the general conditions of sale, as well as the amounts corresponding to the products and the shipping costs in order to continue.

Availability

All purchase orders received by ARUAL through the Website are subject to the availability of the products and/or that no circumstance or force majeure affects the supply of the products and/or the provision of the services. In the event of difficulties in the supply of products or if there are no products in stock, ARUAL undertakes to contact the User and reimburse any amount that may have been paid by way of payment. This shall also apply in cases where the provision of a service becomes unfeasible.

Prices

The prices displayed on the Web are the final prices, in Euros (€) and include taxes, unless, by legal requirement, especially regarding VAT, a different matter is indicated and applied.

Shipping costs are shown appropriately at the corresponding time of the order. The cost of each shipment may vary depending on the method of shipment and payment, as well as the destination and the total amount of the order.

Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received an order confirmation.

Methods of payment and invoicing

Invoices will be issued by e-mail. Invoicing data is extracted from the information provided by the user. It will not be possible to modify the data after the invoice has been issued.

The method of payment is by debit/credit card.

Shipping and handling

Shipping costs for Spain (peninsula, not shipped to the Canary and Balearic Islands) and Portugal (peninsula) are 5.00 euros, except for purchases over 30 € in which case they are 0 €. With deliveries of 24-48h

We do not ship to the Balearic and Canary Islands.

The price is shown prior to the completion of the purchase process how much the shipping costs amount to, expressly accepting them.

The ordered products are delivered to the address specified by the user.

Deliveries will be made Monday through Friday, during normal business hours, excluding national holidays.

When the transport company delivers the PRODUCTS, the user is obliged to check that the security seal is intact and that the packaging is not damaged or altered and that the number of items delivered corresponds to the number indicated on the transport document.

Discount coupons and promotions

Discount coupons or promotional codes may be used and can be entered when the user fills out the purchase order. The system will update the total amount of the order

Right of withdrawal and returns

The user has the right to request the withdrawal from the contract and the return of the products within the first 14 calendar days from receipt of the order, provided that the products are in the same original purchase conditions.

The user may choose to request a refund of the amount of the item or exchange it for another item available on the website. The return costs correspond to the user.

The user is responsible for any deterioration of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. Reimbursement may be suspended until the goods are received and the products are verified.

On the other hand, for reasons of health protection or hygiene, ARUAL does not accept returns of unsealed products.

The user shall return or deliver the products directly to the address stated herein, without undue delay and in any case not later than 14 calendar days from the date on which he communicates his decision to withdraw from the contract.

Warranties and defective products.

The products offered on the website are in accordance with national and EU legislation. The products may differ from the real ones due to configurations in the systems and devices used for their visualization.

In case of non-conformity of the products, the user has the right to immediate reimbursement or replacement of the non-conforming merchandise, after communicating via e-mail to [email protected] with proof of damage or non-conformity of the product.

ARUAL shall not be liable for negligent or improper use of the purchased product.

Applicable law and jurisdiction
